AS, Anny said that I was being a rasist against shiaas b/c I said in dahyie they sell LOADS of fake products, since the point of this topic was that M14ers are thieves and dont care about copyright, This example showed that no lebanese cares for copyright (ana awaloun)... so that why I said that she had a "Dahyie lana" mentality...

بموضوعية وبتجرّد وبما يمليه القانون والضمير

اتخذ، قاضي الأمور المستعجلة في بيروت القاضي فادي النشّار، قراراً نافذاً بمنع تلفزيون" المستقبل" من بثّ" كليب" يحرّض ضدّ المدير العام السابق للأمن العام اللواء الركن جميل السيّد ويوحي بعلاقته بجريمة اغتيال الرئيس رفيق الحريري.

وألزم النشّار التلفزيون المذكور بإزالة صورة السيّد عن هذا الشريط في ضوء عدم صدور حكم قضائي بحقّه.

وجاء القرار الجريء للنشّار على النحو التالي:

"إنّ قاضي الأمور المستعجلة في بيروت، لدى الإطلاع:

حيث من الثابت بالأوراق وبالقرص المدمّج المرفق والذي يعرض لجريمة اغتيال الرئيس الشهيد رفيق الحريري ورفاقه، وورود صورة اللواء الركن جميل السيّد الموقوف بموجب مذكّرة توقيف صادرة عن قاضي التحقيق العدلي بشكل يوحي بصورة واضحة مسؤوليته وعلاقته بالجريمة.

وحيث أنّ إيراد الوقائع الموصوفة أعلاه خارج ملف التحقيق الأولي، وفي الإعلام المرئي، لمن شأنه أن يمسّ ويناقض قرينة البراءة التي يفترض أن يتمتّع بها كلّ موقوف لحين صدور حكم بحقّه، الأمر غير المتوافر في الحالة الحاضرة.

وحيث أنّ بثّ التقارير الإعلامية حقّ مكرّس قانوناً كما الحقّ بعدم نسبة جرم لشخص علناً لحين صدور حكم بحقّه.

وحيث يختص قاضي الأمور المستعجلة بإزالة التعدي الواضح على المعترض وفقاً للفقرة الثانية من المادة 579 من قانون أصول المحاكمات المدنية معطوفة على المادة 604 منه، بالنظر لطبيعة المسألة.

نقرّر:

إلزام شركة تلفزيون المستقبل ش.م.ل. ممثّلة برئيس مجلس إدارتها ومديرها العام السيّد سمير حمود بإزالة صورة اللواء الركن جميل السيّد من الشريط المتعلّق بجريمة اغتيال الرئيس الشهيد رفيق الحريري، وذلك بالشكل الواردة فيه، على أنّ له علاقة ثابتة وواضحة في الجريمة، وذلك على ضوء عدم صدور حكم قضائي بحقّه، على أن ينظر بالمقتضى على ضوء عدم التنفيذ".
