يسود تكتم شديد بشأن قرار مجلس شورى الدولة المتعلّق بدعوى النائب ميشال عون لعدم طمر آثار مدينة أرتوزيا التي وجدت في الجزء القديم من مخيم نهرالبارد. وتشير بعض المعلومات إلى صدور القرار يوم السبت الماضي. واكتفت مصادر فلسطينية بالتأكيد أن القرار إيجابي بالنسبة إلى أهالي المخيم.

Saniora orders the construction at Bared camp to continue, despite important archaeological finds.

Caretaker Prime Minister Fouad Saniora has ordered that all reconstruction work resume at the war-scarred Nahr al-Bared Palestinian refugee camp near Tripoli, as a State Shura Council decree stopping part of the rebuilding expired this month without the council making a final ruling.

Siniora informed Palestinian representatives on Friday that the government had instructed the UN Relief and Works Agency (UNRWA) to restart the reconstruction project in dispute, despite the possibility that the council might still decide for a permanent halt to the process.

The State Shura Council declared a suspension of a part of the reconstruction on the basis of a petition submitted by Free Patriotic Movement (FPM) head Gen. Michel Aoun, who asked the council to end backfilling – the process of burrying ancient artifacts unearthed under the camp – in order to protect the antiquities at the site.

At the centre of the controversy, are the remains of the ancient city of Arkazia, which experts claim was an important centre of trade in the ancient world, and an important part of Lebanon’s heritage. according to Anis Chaaya, the government’s former chief archeologist in North Lebanon, the ancient city of Artozia was real and existed from the Bronze Age in the 14th century BC until the beginning of the Mamluk period in the 13th century AD.

Also according to Chaaya, the government’s plan to rebury Artozia “arbitrary from a scientific point of view” and a violation of the Law of Antiquities, which prohibits burying ruins without undertaking appropriate archeological research. Such research, he said, takes longer to complete than the two month suspension ordered by the Shura Council.

If the State Shura Council rules in favor of Aoun’s suit and prohibits backfilling, UNRWA will have to rebuild much of the camp on a different site, meaning many of Nahr al-Bared’s some 31,000 registered residents would be moved to another part of the camp. Much of the camp was destroyed in a three-month battle between the Lebanese Armed Forces and Fatah al-Islam militants in mid-2007.
UNRWA will resume re-burying the site early next week, according to spokeswoman Hoda al-Turk.

لجنة الدراسات في "التيار الوطني":
طمر آثار البارد مخالف للقانون

حذرت لجنة الدراسات في "التيار الوطني الحر" جميع الأطراف من معاودة العمل على طمر الآثار الموجودة على تلّ أرطوسي، قبل أن يصدر مجلس الشورى حكمه النهائي في هذه القضية".
وقالت في بيان امس ان " بعض الصحف ينشر الأخبار والتعليقات حول إعادة الإعمار في مخيّم نهر البارد، وتربطها بمسألة الآثار التي عثر عليها في المكان المذكور، وبالطعن الذي قدمه النائب العماد ميشال عون الى مجلس شورى الدولة مطالبا بإبطال القرار الصادر عن مجلس الوزراء والقاضي بطمر تلك الآثار، خلافا لتقرير اللجنة العلمية التي أوفدتها المديرية العامة للآثار من أجل إجراء التنقيبات اللازمة".
ورأت ان "تلك الاخبار تحوي جانبا كبيرا من المغالطات، كأن القصد منها تضليل الرأي العام اللبناني عموما، والفلسطيني خصوصا، اضافة الى تشويه أهداف التيار وإثارة اللاجئين الفلسطينيين ضده".
وذكّرت اللجنة بأن "رئيس حكومة تصريف الأعمال فؤاد السنيورة أبلغ الأونروا أن بامكانها استئناف الإعمار، وأن وزير الثقافة تمام سلام بحث في مسألة طمر الآثار وآلياته مع مدير الأونروا سالفاتوري لومباردو خلال لقاء عقد في السرايا. لذلك، فاننا نهيب بالرأي العام اللبناني والفلسطيني اعتبار هذه الأخبار غير صحيحة ما دامت منسوبة الى مصادر مجهولة الهوية. والحقيقة أنه لا يستطيع أحد أن يأمر بإعادة طمر الآثار الموجودة على التلّ ما دام مجلس الشورى لم يصدر بعد أي حكم في هذه القضية، ولا سيما ان المستدعي (النائب العماد عون) قد تقدّم بواسطة وكيله المحامي وليد وديع داغر بلائحتين جوابيتين (تاريخ 21 / 09/ 2009 و22/ 09 / 2009)، وكلتاهما تطلبان من مجلس شورى الدولة ابقاء قرار وقف التنفيذ الى حين صدور القرار النهائي".
وحذرت "جميع الأطراف المعنيين بهذه المسألة من أن معاودة العمل على طمر الآثار الموجودة على تلّ أرطوسي، وقبل أن يصدر مجلس الشورى حكمه النهائي في هذه القضية، هو عمل مخالف للقوانين اللبنانية، ومن شأنه تعريض أصحابه للملاحقة القانونية".
وناشدت مجلس شورى الدولة "التعجيل في اتخاذ القرار النهائي الذي يراه مناسبا في هذه القضية، منعا لأي استغلال سياسي أو تضليل إعلامي، وللتعجيل في عملية إعمار المخيّم من أجل إسكان اللاجئين الفلسطينيين وبأفضل طريقة ممكنة".
