Military Service/Khidmet 3alam - The Orange Room

I just called one of the military offices in Beirut and asked for the military service isti3lemet offices, and I asked that if I'm EXEMPTED (born 1981) since my brother (born 1975) did the military service, and we are only 2 persons in the family.

He said yes, and that I need an family ikhraj ayd, my brother's military service card, and my daftar jesh.

Of course the phone call was real quick, so I couldn't speak much and just got that info hek 3al saree3.

I just wanted to ask does anybody else have more concrete info on this?

I've been a "fugitive" since September 20, 2004

Worse comes to worst, they're going to cancel army for SURE in 2007, according to what I've heard.

I think being a fugitive has another story, so I dont know if the law really applies in your case. I heard Abdul Raheem Mrad once on TV saying that the law will also apply on fugitives but I am not sure.

But according to the law you shall be exempted, but the only concern is if being a fugitive will affect the application of the law.

Hmmm...let me clarify the fugitive part a little bit.

I travelled on September 20, 2004 on a TOURIST visa to Kuwait. Now my daftar, was NOT expired by then. It would expire on November 15th of 2004.

Now, the catch is, you'r not allowed to travel 1 month before expiry. That's why Amn el 3am at the Airport was cool, since September 20 is more than 1 month behind November 15. See what I mean?

So like...I'm a 'legal' fugitive since I have a work permit here in UAE now....i think....right?

Ah bon? they changed the rules? again? so now only one person in a family has to do the military service?? doesn't seem rational

Why didn't you do the necessary papers in the LEb embassy over there? If it is like in europe, you can go to the embassy with your work permit, job contract, and some additional paper and they would extend the exemption..

From what I've heard it was first reduced to 6-months in November. Ba3dena in late January they came up with the law that in 2007 there will be a definite exemption and like mentioned above fi tas-heelet for people who've been residing abroad before the laws were changed...like me!

Ba3dena I heard rumors from many people, and articles on Naharnet and Daily Star that they might exempt people who's brother's have served.

For example...in a family of 2 boys, only one child has to serve...in a family of 3, 2 have to serve...and so on and so forth....for the time being until 2007 when they finally cancel Military service.

Enno I could wait till then......but I do miss Lebanon.

I think I'll give the embassy a call.

Not might anymore, it is a law now, it has been passed and it will be effective on May 5 2005 then I will submit my papers and get my exemption !

It is good that you guys may get an exemption thanks to this law,
but this is by far the most ridiculous stupid discriminating law ever!! c le comble du ridicule!

OK here's the new law.According to this law all deserters will have legal status after 5 may 2005, if you're married even if you don't have kids you're automatically exempted,only 2 kids have to serve in families of 3(males) and more and only 1 in families of 2(males)....

نشر في الجريدة الرسمية القانون رقم 665 تاريخ 4 شباط 2005 المتضمن تعديل بعض أحكام المرسوم الإشتراعي

الرقم 102 تاريخ 16-09-1983 ووقف العمل بالقانون الرقم 310 تاريخ 03-04-2001 المتعلق بخدمة العلم.

وفي ما يأتي نص القانون:

- المادة الأولى: خلافاً لأي نص آخر، تلغى خدمة العلم المنصوص عليها في المرسوم الإشتراعي 102 تاريخ 16 / 9 / 1983 ( قانون الدفاع الوطني ) بصورة نهائية بعد مرور سنتين على نشر هذا القانون في الجريدة الرسمية.
- المادة الثانية: تلغى الفقرة الأولى من المادة 105 من المرسوم الإشتراعي الرقم 102 تاريخ 16/9/1983.
تعدل الفقرة الثانية من المادة 105 من المرسوم الإشتراعي الرقم 102 تاريخ 16/9/1983 بحيث تصبح على الوجه التالي:
تخفض مدة خدمة العلم إلى ستة أشهر وذلك إلى حين الإلغاء النهائي المنصوص عليه في المادة الأولى من هذا القانون.
- المادة الثالثة: تضاف إلى المادة 105 من المرسوم الإشتراعي 102 تاريخ 16/9/1983 الفقرة الآتية:
" يمكن وفقا لحاجة قيادة الجيش والقوى المسلحة، تمديد خدمة من يرغب من المجندين الرتباء والأفراد بعد انتهاء خدمتهم الإلزامية لفترة لا تتجاوز خمس سنوات بالرتبة التي كانوا فيها، يتقاضون خلالها تعويضاًَ شهرياً يوازي راتب الدرجة الأولى المستحق لرتبة المتطوع التي يكون فيها كلا منهم، وتطبق عليه جميع الحكام القانونية التي ترعى أوضاع المجندين طوال مدة خدمتهم.
يبقى للمجند الذي مددت خدمته الحق في إنهاء خدمته في نهاية أي سنة من سنوات التمديد".
- المادة الرابعة: تعدل الفقرة الأولى من المادة 109 من المرسوم الإشتراعي الرقم 102 تاريخ 16/9/1983 بحيث تصبح على الوجه الآتي:
" تؤجل دعوة المواطن إلى خدمة العلم حتى سنة قابلة للتجديد ضمن الشروط المنوه عنها في الفقرة / 1 / من المادة 108 أعلاه، على ألا تتجاوز هذه المدة حد إكماله الثالثة والثلاثين من عمره حيث يستدعى لأداء خدمته".
- المادة الخامسة: يعدل البند /2/ من المادة 112 من المرسوم الإشتراعي الرقم 102 تاريخ 16/9/1983 بحيث يصبح على الوجه الآتي:
" تعطى أفضلية تحدد شروطها بمراسيم تتخذ في مجلس الوزراء للمجندين الذين نفذوا موجبات خدمة العلم في الدخول إلى مختلف القوى المسلحة".
- المادة السادسة: تسريع الأحكام الجديدة المنصوص عليها في هذا القانون على الذين يؤدون خدمة العلم في تاريخ نفاذه.
- يوقف العمل بالقانون 310 تاريخ 3/4/2001 .
- المادة السابعة: تضاف إلى حالات الإعفاء النهائي أو المؤقت من موجبات خدمة العلم المنصوص عليها في المرسوم 3778 تاريخ 13/7/1993 الحالات المنصوص عليها في الجدول الملحق بهذا القانون.
- المادة الثامنة: توقف الملاحقة في حق المتخلفين عن خدمة العلم وتسقط كل التعقبات والأحكام في حقهم لهذه الجهة فور صدور هذا القانون ويعاد اعتبارهم حكماً.
- المادة التاسعة: تلغى كل النصوص القانونية والتنظيمية المخالفة لأحكام هذا القانون أو غير المؤتلفة مع مضمونه.
- المادة العاشرة: ينشر هذا القانون في الجريدة الرسمية ويعمل به بعد مرور ثلاثة أشهر من تاريخ صدوره".

وتضمن الجدول الملحق الآتي:

" تضاف الحالات المبينة أدناه إلى حالات الإعفاء الحكمي والنهائي ومن دون أي إجراء قانوني:
1. المعيل لعائلته.
2. المتزوج حتى لو حصل الزواج في أثناء فترة الإعفاء الموقت.
3. المقيمون خارج لبنان بما في ذلك البلدان العربية.
4. الموظف.
5. الطلاب بمن فيهم من يتابع الدراسات العليا.
6. أشقاء من يؤدي خدمة العلم في العائلة المكونة من 3 أولاد وما دون.
7. باقي أشقاء الولدين اللذين يؤديان خدمة العلم في عائلة مكونة من أكثر من 3 أولاد".
