No offense Danny, but your point of view is so economical! Do you major in economics? I mean you give that Somali example by saying that whether or not the Somalian coast should be invaded (and thousands killed) is relative to a cost/benefit analysis! This has no longer anything to do with justice not even with anything that is just!
Rational vs emotional is not the way I would put it. It's not emotions that would justify punishing him with an equal treatment. I call that Justice in its definition revolving around equity!
Specially your last paragraph is contradictory and too economical. According to you, the same crime should be punished differently according to the cost of maintaining a person in jail. Although departing from a rational analysis, the conclusion is far away from rational and gives Justice a relative character.
Since Justice to you is relative, why can't you understand that burning the eyes of that sadistic man is Just?
Besides, I could also use your theory and justify the judgment: Since burning of eyes is a dangerous thing and happens very often in some countries, then the burning of eyes as a legal punishment can be used as a deterrent tool of dissuasion. Potential eye-burners will think twice before using such methods!
