You are asking all the wrong or rather irrelevant questions.
You and I do not need to know technical aspects of WP action simply because none of us represents internationally recognized and respected entity. Our opinions do not count when criminal charges are leveled. However, HRW's does and it is their job to investigate and report. When they will report we will be able to appreciate real situation rather than engage in speculations.
BTW, after HRW reports it will be burden on IDF to respond whether by agreeing or by refuting the charges but eventually if there is no agreement everything may come down to court hearings.
Alternatively each of us does not have to wait for it but simply
assume how thing are according to our personal bias(es). And this is exactly what we are doing.
